Manipedime.com Terms of Service

By using the Manipedime.com web site and any Manipedime Pedicash™ services (“Service”) of Manipedime, LLC (“Manipedime”), you (User”) are agreeing to be bound by the following terms and conditions (“Terms of Service”). Violation of any of the terms below will result in the termination of your Account.

Manipedime reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, will be subject to the Terms of Service. Continued use of the Service after any such changes will constitute your consent to such changes. General Terms and Conditions of Service

The Service provides Users the ability to purchase Manipedime Pedicash™ gift cards (including certificates and vouchers) and to identify Participating Spa Affiliates and locations where customers may redeem Manipedime Pedicash™ cards.

You acknowledge and agree that Manipedime may establish general practices and policies concerning use of the Services.

  1. You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
  2. You must be a person representing yourself or an organization. Accounts registered using automated methods are not permitted and will be terminated.
  3. You are responsible for maintaining the security of your account and password. Manipedime cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  4. You are responsible for all activity that occurs under your account.
  5. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.
  6. One person or legal entity may not maintain more than one account.
  7. You will not use the Service to copy, distribute, transmit, display or infringe the intellectual property rights, or violate the privacy rights, of any third party.
  8. We claim no intellectual property rights over information you provide. Your profile and any User information stored and/or shared remain yours. However, by sharing User information through the Service, you agree to allow others to view, edit, and/or share your information as may be necessary for your transactions using the Service.
  9. Manipedime has the right (but not the obligation) in its sole discretion to refuse or remove any User information that is shared via the Service.
  10. Manipedime respects the intellectual property of others, and we ask our users to do the same.
  11. A physical or electronic signature of a person authorized to act on behalf of the user of the Service may be required.
  12.  You use the Service is at your own risk. The service is provided on an “as is” and “as available” basis.
  13. You understand that Manipedime uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
  14. You must not modify the Service nor modify another website so as to falsely imply that it is associated with the Service or Manipedime.
  15. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the prior written permission of Manipedime.
  16. You understand that use of the Service may involve transmissions over various networks and changes may be required to conform and adapt to technical requirements of connecting networks or devices.
  17. You are not permitted to upload or transmit unsolicited email i.e., “spam” messages.
  18. Manipedime does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, or error-free, or (iii) any errors in the Service will be corrected.
  19. You expressly understand and agree that Manipedime shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Manipedime has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; (v) or any other matter relating to the Service.
  20. The failure of Manipedime to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Manipedime and govern your use of the Service, superseding any prior agreements between you and Manipedime (including, but not limited to, any prior versions of the Terms of Service).

  22. A valid credit card is required for purchasing Manipedime Pedicash™ certificates.
  23. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
  24. You are solely responsible for properly canceling your account. You may cancel your account by sending an email to support@manipedime.com
  25. All of your User information will be deleted from the Service one month after cancellation. This information can not be recovered once it has been deleted.
  26. Manipedime, in its sole discretion, has the right to suspend your account and refuse any and all current or future use of the Service, pending investigation, for any reason at any time. Such termination of the Service may result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all User information in your Account. Manipedime reserves the right to refuse service to anyone for any reason at any time.
  27. Manipedime reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  28. Prices of all Services, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes on our web site (www.Manipedime.com).
  29. Manipedime shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
